Communications

 

MOA Lundbohm is appointed as the parliamentarian for this, his last House of Representatives Meeting prior to his, well deserved, retirement. GOOD LUCK LUMMY, WE WILL ALL MISS YOU, YOU HAVE BEEN A GREAT ASSET TO THIS ORGANIZATION!

 

The President opened the meeting with an overview of the Representative school that had been conducted, by our Criminal Attorney’s, along with a reminder that part 2, featuring our Labor Law firm, will be held prior to the start of our February meeting.

 

The president read into the minutes the following resignations:

The President then ordered all vacant shift representative positions to be posted effective Thursday January 19th thru Thursday February 3rd with elections if necessary to be held on February 16th, 2012 at the respective districts.

 

President Nee then discussed a possible issue with certain pharmacies and Blue Cross Blue Shield Health Insurance Provider. It appears that the Blue Cross is having some difficulties with certain pharmacies and their pricing structure, creating a problem for the subscriber (us) and the contractor (the pharmacy). This is resulting in certain members being told that their preferred pharmacy no longer accepts Blue Cross. If that’s the case, presently there is nothing that we, as a union, can do about it. Members will have to go to another pharmacy to accept their business. However, we are in contact with the City of Boston and attempting to have them mediate a solution between the Vendor and Provider. (As of the posting of these minutes, it has come to our attention that the Vendor is Walgreens. All other Vendors are still participants within the BCBS system. If you are having problems with any other Vendor accepting your medical insurance, please contact the Union immediately).

Grievance Report

 

Grievance report was presented by Ron MacGillivray

 

The Vice President reported out that both the Christmas Holiday and New Years Holiday payrolls should appear in our next two weekly paychecks.

 

Ron led a discussion concerning ‘Court Vacation Days’ and re-iterated the fact that the so called ‘CV Days’ must be used immediately following your vacation period.

 

There was further discussion and explanation of the so called ‘Training Day’ arbitration. When you earn a W/I for training on your day off and wish to utilize the W/O for that day, you are to identify it to your clerk and cannot be refused that day off EXCEPT on the following three (3) days: First Night, Marathon Monday and Caribbean Festival, (as outlined in our CBA and verified through an Arbitration Award).

 

The Vice President then discussed the upcoming ‘Expedited Arbitration Day’ planned for February 8th. He further explained the process to the Representatives and his hope of achieving satisfactory outcomes on the cases presented. He plans on being able to arbitrate four (4) cases per day.

 

There was further discussion concerning the current W/O, W/I situation within the department and the lack of a bargained agreement with us.

 

There was a discussion concerning ‘Oral Reprimands’ and ‘Written Reprimands’ insofar as their actual physical harm to an employee and whether or not these type of ‘Reprimands’ are grievable. According to our Labor Attorney if there is no physical harm or loss of benefits there is no grievance. Ron went on to explain that ‘Oral Reprimands’ are district/unit level only. You as the member are allowed to attach your version of events in writing to any ‘Oral Reprimand’, a so called rebuttal. Further, an ‘Oral Reprimand’ does not follow the member after transfer. Rule 325 Governs Oral Reprimands.

 

There was also discussion concerning the ‘Licensed Premise Rule’. You are only able to perform two (2) paid details per month at any particular licensed premise without a Supervisor. You are not allowed to accept a licensed premise detail if it is ASSIGNED to you if it conflicts with your schedule and doesn’t allow you to be there for FOUR hours. The exception is if the detail is unfilled at say; 11:45pm on a particular night and OFFERED out because it is not filled, then members ARE allowed to accept it in those cases.

Legislative Report

It is reported out that the Budget is still a work in progress, however it is believed that there is a projected shortfall in the hundreds of millions of dollar range, (didn’t we hear that one last year and they still managed to bank a half a billion into the rainy day account?). There are also very strong rumors that the Esteemed Governor plans on presenting a proposal to raise taxes in the State of Massachusetts.

 

There also appears to be strong rumors of probable indictments concerning the ‘Probation Department’ probe and inquiries that have been ongoing. (Which has absolutely nothing to do with us, just info).

 

There is absolutely no movement by anyone in the State Legislature to assist us in regaining the ‘Quinn Bill Funding’ through state resources.

Treasurers Report

Motion by Pratt and 2nd by Fitzgerald to accept and pay the months legal bills.

Tommy Pratt then stepped down and turned the Treasurers duties over to our newly elected Treasurer: David ‘Duke’ Fitzgerald, wishing him great success!

Good of the Order

 

Mike Leary addressed the House of Representatives with a Congratulations to David Fitzgerald for his Victory in the recent Treasurer’s Election. Dave mounted a good campaign and was chosen by the members. Mike thanked all of the members that supported his campaign and asked that we all support the New Treasurer and continue to support the BPPA and its’ mission in providing for and protecting our members and their families.

 

President Nee discussed the position postings for the ‘Pine Street Inn’. He stated that the position posting has been withdrawn. He outlined the reasons he believed it to be an improper posting. He further stated that he would have no problem with the positions if they were “reimbursable overtime”, so that it would be available to everyone in AREA D, the same as any other paid detail. He further stated his concerns about “privatizing” police details by the department providing some type of private contracting of our services to outside vendors or facilities. This is not to be confused with our desire to win back jurisdiction within Mass Port and or the waterfront.

 

A lengthy and in depth discussion concerning ‘Training Days’, change of shift for ‘Training’, ‘Travel Time’ for training, ample time off after training and etc. Discussion about new problems that have suddenly appeared due to the ‘New’ W/O and W/I policies that the Department or District/Unit Commanders have implemented without knowledge or agreement by the BPPA.

 

Area F raised many concerns about not training properly with their respective units due to some unwritten policy stopping them from training on their day off. The Representatives raised serious concerns that certain specialty units might lose certification or worse, put fellow Officers safety in jeopardy due to not training together as a cohesive unit.
